This extensive centenary law was invoked by President Donald Trump. He accused the Venezuelan gang Train of Aragua (ADD) of « perpetrating, trying and threatening a predatory invasion or raid » in the United States territory.
A lower court had temporarily blocked these deportations on March 15, feeling that the administration’s actions under the law needed more scrutiny. But in a decision of 5-4 on April 7, the Supreme Court lifted this block, on the shores of Trump, while also ordered procedural guarantees.
What is the act?
The Alien Enemies Act grants the President of the United States who carry powers to order the arrest and deportation of natives or citizens of an « enemy » nation without following the usual processes.
It was approved as part of a series of laws in 1798 when the United States believed it would enter a war with France.
The law states that « as long as there is a declared war (…) or any predatory invasion or incursion will be perpetrated, attempted or threatened » against the United States, all « subjects of the nation or hostile government » could be « captured, restricted, secured and eliminated, as foreign enemies. »
When has been used more?
The event was used only three times, all in times of conflict involved in the United States.
She was last invoked in World War II, when people of Japanese offspring, according to about 120,000, was imprisoned without trial. Thousands were sent to the internally fields.
People of German and Italian ancestry were also interned during that time.
Earlier, the event was used during the war of 1812 and the First World War.
What did Trump say, and what has been the reaction?
Although this is the first time the event has been used by Trump, this is not the first time it has mentioned it.
At his inaugural address in January, he said he would invoke the act to « eliminate the presence of all foreign criminal bands and networks that would carry a devastating crime on the ground. »
In its Saturday proclamation, Trump invoked the writing of the law accusing ADHD of threatening a « invasion » against the United States. He declared his members « susceptible to being captured, braked, secured and eliminated as alien enemies. »
Trump’s decision has been criticized by rights groups. The American Union of Civil Freedoms (ACLU) sued the removal for reasons that the United States was not at war.
Speaking to BBC News on Sunday, Lee Gerarnt, an ACLU lawyer, said: « There is no doubt in our minds that the law is raped. »
Federal judge James Boasberg sought to stop the use of the law to carry out deportations, but the White House said that this had « no legal basis » and that the removals had already taken place.
This led to a decline between the Federal Judge, located in Washington DC, and the government. Boasberg dismissed the Government’s response to his order as « inadequately unfortunate » and warned of consequences if the Trump administration had violated his sentence.
Donald Trump returned to social media, saying that Boasberg should be prevented and called « tribe ».
Reacting to a news article covered by the original order of the judge, El Salvador’s President Nayib Bukele wrote on social media: « Oopsie … too late. »
Venezuela criticized Trump’s use of the act, saying that he « unfairly criminalizes Venezuelan migration » and « evokes the darkest episodes in human history, from slavery to the horror of Nazi concentration camps. »
Katherine Yon Ebright, counselor of the Center of Justice of Brennan, said in a statement that the use of Trump from aliens enemies was illegal.
« The only reason to invoke this power is to try to allow the arrests and deportations of Venezuelans based on their ancestry, not on any band activity that could be demonstrated in immigration procedures, » he added.
