The Trump administration argues that Abrego Garcia is a member of the MS-13 band who is suspected of human trafficking and has a violent story of abusing his wife.
A 2022 national security research report identified Garcia as Member of MS-13 and an alleged human trafficker. A presentation of domestic violence of 2021, written by his wife, Jennifer Vasquez, stated: « I have several photos/videos of how violent it can be and of all the bruises that he has left me. »
Democrats say he is a working -class Maryland resident who has shot his rights due to the process after being sent to the notorious prison.
The Supreme Court acknowledges that ABREGO GARCIA was subject to a 2019 withholding order that prohibited its withdrawal to El Salvador and that the retreat to El Salvador was « therefore illegal ». The court emphasized that the Government must facilitate its release of custody to El Salvador and treat its case as if it were never deported.

Trump administration officials acknowledged to the court that their deportation had been an administrative error, although some main Trump officials now say he was properly retired and said that he is a member of the notorious MS-13 Colla.
An immigration judge in 2019 found that Garcia had not refuted enough MS-13 affiliation tests and, therefore, was removable anywhere else than the Salvador due to a threat of a rival gang. This is called withholding order.
