Harvey Weinstein’s New York recovery begins for sexual assault burdens. What is different this time?

Five years after Harvey Weinstein was convicted of rape and prison in the handcuffs, the old Mogul movie returns to a Manhattan court on Tuesday for a new trial that covers many of the same allegations, as well as one that has not been tested earlier.

Now 73, he is far away from the moment he was among the most powerful men in the cinema business.

The movie Miramax and then Weinstein Company won 81 nominations from the Academy from 1988, including six best pictures winners. While their harassment behavior was an open secret to the film industry, a couple of exhibitions published days apart from the New York Times and the New Yorker in 2017, they saw several women annul allegations of sexual assault and, in some cases, violations.

The articles, as well as a tweet by actress Alysa Milano, days later galvanized a #MeToo movement and encouraged more women to make public with complaints of predatory men’s behavior through industries.

New York’s highest court has annulled Harvey Weinstein’s sentence in 2020 for sexual aggression and violations, a milestone in the #MeToo movement. Andrew Chang explains how the prosecution knew he was making a bet, and where this game went wrong.

Within a few days, Weinstein was fired from his company and his wife began divorce procedures. A Grand Jury in New York accused him in the spring of 2018, the first step towards his criminal trial.

For recovery, Weinstein has not stated guilty and denies that he violated or sexually assaulted anyone. Prosecutors cannot try again to Weinstein in some cases that he was acquitted during his first trial.

Why is there a new judgment?

The State Appeal Court released Weinstein’s sentences and a 23 -year prison sentence, and ordered a new trial after noting that the original was leaned on by « clumsy » court rulings and harmful testimonies.

In a 4-3 decision, the court said that James Burke had denied Weinstein a completely fair trial, let three women testify about allegations that were not part of the case.

The court labeled complaints against Weinstein « horrible, shameful and repulsive behavior », but warned that « destroying the character of a defendant under the costume of fiscal need » did not justify some evidence and testimonials of judgment.

What is the new charge that faces?

Weinstein faces complaints not heard at the first trial, resulting from a Criminal Sex Law count to allegedly force oral sex to a woman from a Manhattan hotel in 2006.

Prosecutors said that the woman appeared to them a few days before the start of Weinstein’s first trial, but was not part of this. They said they did not pursue women’s allegations after Weinstein’s conviction, but they were reviewed and reached a new accusation after the first verdict was launched.

Weinstein’s lawyers claim that prosecutors should not have been waiting for almost five years to submit the additional accusation.

What allegations will be heard again?

Weinstein is back in two positions of his original judgment.

It faces a criminal sex act to allegedly interpret oral sex in a film and television production assistant.

Haley, who also had the name of Mimi Haleyi, acknowledged that he kept in contact with Weinstein, exchanged warm messages with him and accepted an invitation to his hotel room two weeks after the alleged assault, where he threw her in bed for sex. According to New York Act, Weinstein has not been accused of rape in relation to Haley’s allegations.

Weinstein also faces a third -degree rape count for allegedly assaulting a Jessica Mann in a hotel room in Manhattan in 2013.

Mann, who said he saw Weinstein a « pseudo father » figure while pursuing an actress career after a hard education, testified at the 2020 trial that he caught her in the hotel room, ordered him to be undressed while dropping and then violated her. She claims that Weinstein raped her again eight months later at a hotel in Beverly Hills, where she worked as a hairdresser.

Mann also contacted Weinstein after the alleged assault, testifying that he sent him flattered emails, because « his ego was so fragile, » he said, and « made me feel safe, worshiping it in this regard. »

Associated Press does not usually identify people who claim sexual assault unless they are nominated, as Haley and Mann have done.

If Weinstein is acquitted in this judgment, would you deliver?

Weinstein last year rejected a request for extradition from California, where he was found guilty of rape, forced oral mating and another sexual behavior count that involved a woman known as Jane Doe 1, after a two -month trial in Los Angeles in late 2022.

He was sentenced early to 16 years in prison, which had to begin after New York punishment was fulfilled.

Weinstein’s conviction in California is a review, but legal experts said that as a result of the defeat of the New York verdict, that the two states had rules that differ in the witness on previous acts and behaviors.
